## Privacy Policy

Last updated: 20 October 2026

### Privacy policy

This policy explains which personal data we process when you visit this website, for what purpose, on what legal basis and for how long, and which rights you have. Terms such as “personal data”, “processing” and “controller” have the meaning given in Art. 4 of the General Data Protection Regulation (GDPR).

#### 1\. Controller

Fidelo Software GmbH
Schanzenstraße 27
51063 Cologne
Germany
Phone: +49 221 975807 56
Email: marketing@fidelo.com

Your contact for all data protection questions is our managing director, Mark Koopmann, at the contact details above. We have not appointed a data protection officer because the legal requirements for doing so (Art. 37 GDPR, Section 38 of the German Federal Data Protection Act, BDSG) do not apply to us.

#### 2\. Hosting

This website and our server at fidelo.com, which runs the enquiry and demo form, are hosted by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany, in data centres in Germany. Hetzner processes the data solely on our behalf and on our instructions; we have a data processing agreement with Hetzner under Art. 28 GDPR.

#### 3\. Server log files

Each time this website is accessed, the web server automatically records information in a log file: the IP address of the accessing device, the date and time of access, the address requested, the HTTP status code, the amount of data transferred, the previously visited page (referrer) and the browser type and operating system (user agent).

We process these data to deliver the website, to ensure its stability and security and to detect and fend off attacks. We do not analyse them for advertising or marketing purposes and do not combine them with other data. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in operating the website securely and without errors. The log files are rotated daily and deleted automatically after 56 days, unless a specific security incident requires individual entries to be kept longer for investigation.

#### 4\. Cookies

This website does not set any login, analytics or advertising cookies. The only cookie is a technically necessary session cookie (_PHPSESSID_) of the domain fidelo.com: it is set by the enquiry and demo form (see section 6), serves solely the technical operation of that form and is deleted as soon as you close your browser. The legal basis is Section 25(2) no. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG) in conjunction with Art. 6(1)(f) GDPR.

Only if we use a web analytics service and you have given your consent beforehand via the cookie banner will that service set cookies; the details will then be set out in a separate section of this policy. Without consent, no such script is loaded and no cookie is set. Regardless of this, you can prevent cookies from being set at any time in your browser settings or delete cookies that have already been set.

#### 5\. Local storage of your language choice

Fonts, scripts and images of the website itself are served from our own server. The only exception is the enquiry and demo form described in section 6: it loads files from fidelo.com and from use.fontawesome.com.

When you choose a language in the language selector, your browser stores this choice in local storage under the key _fidelo-lang_, so that we can show you the same language version on a later visit. This information stays on your device, is not transmitted to us or to third parties and does not contain any personal data. The legal basis is Section 25(2) no. 2 TDDDG. You can delete it at any time in your browser settings.

#### 6\. Enquiry and demo form, contact by email or phone

**Form.** The form on this website is a form module of our own software. When you open a page that contains the form, your browser loads the necessary script and style files from our server at fidelo.com; in the process, your IP address and the technical data listed in section 3 are transmitted to that server. The details you enter in the form are only transmitted when you submit it and are then stored in our software.

**Font Awesome.** To display icons, the form module loads stylesheets and font files of the Font Awesome service from the server use.fontawesome.com. The provider is Fonticons, Inc., based in the USA. When these files are loaded, your IP address is transmitted to that server. When we checked on 28 September 2026, the service did not set any cookies while these files were being loaded. Further information can be found in the provider’s privacy policy at https://fontawesome.com/privacy.

**Email and phone.** If you contact us by email or phone, we likewise process your details (such as your name, contact details and the content of your message) to handle your request.

**Purpose and legal basis.** We use your details solely to answer your enquiry, to arrange and hold a demo with you and, where applicable, to send you an offer. The legal basis is Art. 6(1)(b) GDPR where your enquiry is aimed at concluding a contract, and Art. 6(1)(f) GDPR in all other cases; our legitimate interest lies in answering enquiries. Loading the form files is based on Art. 6(1)(f) GDPR; our legitimate interest lies in providing a functioning form.

**Recipients.** Your details are not sold and are not used for third-party advertising. The only recipients are service providers acting on our behalf: Hetzner Online GmbH as our host (see section 2) and, for our email communication, Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland (Microsoft 365). We have a data processing agreement with Microsoft under Art. 28 GDPR. A transfer of data to the USA cannot be fully ruled out; Microsoft is certified under the EU-US Data Privacy Framework, for which the European Commission has adopted an adequacy decision (Art. 45 GDPR).

**Retention.** If no contract is concluded, we delete the details relating to you as a person (such as your name, contact details and notes on our conversations) 36 months after our last contact. Details about your organisation that do not relate to a person, such as the name and size of the school or the system it currently uses, are kept beyond that. If a contract is concluded, we keep documents that we must retain for commercial or tax law reasons (such as offers, contracts, invoices and business correspondence) for the statutory periods of six to ten years (Section 257 of the German Commercial Code, HGB; Section 147 of the German Fiscal Code, AO).

#### 7\. Job applications

If you apply for a job with us, for example by email, we process your details and documents to carry out the application process. The legal basis is Section 26 BDSG in conjunction with Art. 88 GDPR, and Art. 6(1)(b) GDPR. If an employment relationship is established, we store the data to carry out the employment relationship in accordance with the statutory provisions. Otherwise, we delete the application documents two months after notifying you of our decision, unless legitimate interests prevent deletion, such as the need to provide evidence in proceedings under the German General Equal Treatment Act (AGG).

#### 8\. Obligation to provide data, automated decisions

You are under no statutory or contractual obligation to provide us with personal data. Without your contact details, however, we cannot answer your enquiry. No automated decision-making, including profiling (Art. 22 GDPR), takes place.

#### 9\. Your rights

You have the following rights with regard to the personal data concerning you:

- right of access (Art. 15 GDPR),
- right to rectification (Art. 16 GDPR),
- right to erasure (Art. 17 GDPR),
- right to restriction of processing (Art. 18 GDPR),
- right to data portability (Art. 20 GDPR),
- right to withdraw consent with effect for the future (Art. 7(3) GDPR).

An informal message to the contact details in section 1 is enough to exercise your rights.

**Right to object (Art. 21 GDPR).** Where we process your data on the basis of Art. 6(1)(f) GDPR, you may object to this processing at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

#### 10\. Supervisory authority

You have the right to lodge a complaint with a data protection supervisory authority about the processing of your personal data (Art. 77 GDPR). The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (LDI NRW), Kavalleriestraße 2–4, 40213 Düsseldorf, Germany, [www.ldi.nrw.de](https://www.ldi.nrw.de/).
